拟送往国外使用的文书,如文书使用国在我国内地设有领馆且开展领事认证业务,同时该领馆领区(即领馆管辖的范围)包括为文书办理领事认证的地方外办所在的省(市、区),该省(市、区)内涉外公证机构或地方出入境检验检疫机构、地方贸促会出具的涉外公证书或其他证明文书,应在该省(市、区)外办办理领事认证。
举个例子说明:如意大利在上海设有总领馆,且开展领事认证业务,其领区包括上海、浙江、江苏等省市。如您的文书在浙江省某公证处出具并拟送往意大利使用,应在浙江省外办办理领事认证后,再送往意大利驻上海总领馆办理领事认证,无需送外交部领事司和意大利驻华使馆办理领事认证。
Documents to be sent to foreign countries, in case the document user country has a consulate in the Mainland of China and carries out consular certification business, and the consular area (i.e. the scope of the consulate’s jurisdiction) includes the province (city, district) where the local foreign office is located for consular certification of the document, and the foreign-related notarization institutions within the province (city, district) or the local exit-entry inspection and quarantine institutions, the local trade promotion association issued foreign-related notarization or other certification documents shall handle consular certification outside the province (city, district).
For example, Italy has a Consulate General in Shanghai and carries out consular certification business, and its consular areas include Shanghai, Zhejiang, Jiangsu and other provinces and cities. In case your documents are issued in a notary office in Zhejiang Province and are to be sent to Italy for use, they should be sent to the Consulate General of Italy in Shanghai for consular certification after applying for consular certification at the Foreign Affairs Office of Zhejiang Province, without sending the Consul Department of the Ministry of Foreign Affairs and the Italian Embassy in China for consular certification.
